1. Agreement
These Terms are an agreement between you and CerebraFit LLC (“CerebraFit”, “we”). By downloading or using MeMotivate you accept them. If you don't agree, don't use the app.
2. What MeMotivate is
MeMotivate offers games, breathing and mindfulness sessions and short videos for mental activity and practice. It is for general, educational and recreational use. It is not a medical device and does not diagnose, treat, cure or prevent any condition. We do not promise any cognitive, health or educational result. Scores reflect practice in the app, not ability or health.
3. Eligibility and your account
You must be at least 13. If you are under the age of majority where you live, use MeMotivate only with a parent's or guardian's permission. Give accurate details, keep your password private, and tell us promptly about any unauthorised use.
4. Licence and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use MeMotivate on devices you own or control, under these Terms and the applicable store rules. Don't copy, resell, reverse engineer or interfere with the app or its servers, access other people's accounts, cheat on leaderboards, or use the app unlawfully, except where the law does not allow these restrictions.
5. Subscriptions and purchases
Some features need a paid subscription bought through the App Store or Google Play. Price, billing period, any free trial and renewal terms are shown before you confirm. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period in your store account settings. Unused trial time is forfeited when you buy a subscription, where the store applies that rule. Refunds are handled by Apple or Google under their policies and any rights you have by law.
Deleting the app or your account does not cancel a subscription.
6. Account deletion
You can delete your account at any time in the app or by email. Deletion permanently removes your progress and scores and cannot be undone. See the Privacy Policy and FAQ.
7. Our content
MeMotivate, including its software, games, artwork, text, audio, video and trademarks, belongs to CerebraFit or its licensors. These Terms don't transfer any ownership to you.
8. Changes and availability
We may add, change or remove features, and we may suspend the service for maintenance, security or legal reasons. We don't guarantee the app will always be available or work on every device.
9. Suspension and termination
You can stop using MeMotivate at any time. We may suspend or end your access if you seriously or repeatedly break these Terms or put others or the service at risk. Termination does not cancel a store subscription.
10. Health and safety
Take breaks, and stop if you feel discomfort or strain. If you have concerns about your memory, attention or wellbeing, speak with a qualified health professional. MeMotivate is not an emergency or crisis service.
11. Disclaimers
To the extent permitted by law, MeMotivate is provided “as is” and “as available”, without warranties beyond those that cannot lawfully be excluded. Nothing here limits consumer rights that cannot be waived.
12. Limitation of liability
To the extent permitted by law, CerebraFit is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or profits, arising from your use of MeMotivate. Our total liability for any claim is limited to the amount you paid us for MeMotivate in the 12 months before the claim. These limits don't apply where the law does not allow them.
13. App store terms
Apple and Google are not parties to these Terms and are not responsible for MeMotivate or its support. If you downloaded the app from the App Store, Apple's Standard EULA also applies, and Apple and its subsidiaries are third-party beneficiaries of these Terms. Where a mandatory store term conflicts with these Terms, the store term controls.
14. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. This does not take away mandatory consumer protections of the country where you live. Please contact us first so we can try to resolve any dispute informally.
15. Changes to these Terms
We may update these Terms. We will change the date at the top and give notice of material changes in the app. Continuing to use MeMotivate after changes take effect means you accept them.
